End user license agreement

Version 1, written 2026-11-01.

This page is the EULA.md that Focal installs and opens from Settings, published at build time so the two cannot differ.

Focal is made by VMEDIA LLC, a Florida limited liability company doing business as VCMEDIA ("we", "us"). This agreement is between you and us and covers the Focal software, its installer, updates and documentation ("Focal"). Installing or using Focal means you accept it. If you do not, do not install Focal.

Written in plain language on purpose. Where a sentence is plain, it means what it says.

1. What you may do

Once you have bought a license, you may install and use Focal on up to three computers that you yourself use. The license is for one person; a team buys one license per person. You may use Focal for any purpose, including making recordings you sell or publish. Everything you record, edit and export is yours.

Before buying, you may use Focal free for 14 days from the first launch, with every feature. Videos exported without a license key carry a "Made with Focal" watermark across the middle of the picture. When the trial ends, recording, editing and exporting stop until a license key is entered.

2. Updates

A license includes every version of Focal published within twelve months of the purchase. After that, the version you have keeps working for as long as you like; an update renewal, when offered, extends the twelve months.

3. What you may not do

You may not copy Focal for others, sell it, rent it, lend it or sublicense it; share your license key or use it on more computers than the license allows; remove or work around the trial, the mark on trial exports, the license check or the signing of the program; or take Focal apart, decompile or disassemble it, except where the law allows that despite this agreement.

4. Ownership

Focal is licensed to you, not sold. We keep every right in Focal that this agreement does not give you. The components Focal is built with belong to their authors and come with their own licenses, listed in THIRD-PARTY-NOTICES.md.

5. Privacy

Focal records on your computer and keeps what it records there. It has no account and sends nothing about your recordings anywhere. What it does send and fetch (the license check, the update feed and the speech model for captions) and where it keeps its files are described in PRIVACY.md, which is part of this agreement.

6. Buying, refunds and keys

Focal is sold through Polar (polar.sh), which acts as the merchant of record: it takes the payment, charges and remits any sales tax or VAT, and issues your license key. Polar's own terms apply to the payment itself. If Focal is not for you, write to support@focalcapture.com within 14 days of buying and the purchase is refunded.

Keep your license key private. A key that is shared or resold may be disabled, and a disabled key stops the copies activated with it.

7. No warranty

Focal is provided as it is. We work to make it reliable, and we fix what is reported, but we do not promise that it is free of errors, that it suits a particular purpose, or that it runs on every computer. To the extent the law allows, there is no warranty of any kind, express or implied.

8. Limit of liability

To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss from using or being unable to use Focal, such as lost recordings, lost time or lost revenue, even if told it could happen. Our total liability to you for anything to do with Focal is limited to what you paid for your license. Some places do not allow these limits, and there they apply only as far as the law permits.

9. Ending the agreement

The agreement lasts as long as you use Focal. It ends if you break it; then stop using Focal and delete your copies. Sections 4, 7 and 8 continue to apply.

10. Changes

A new version of Focal may come with a revised agreement; it applies when you install that version. The version you have keeps the agreement it came with.

11. Law

This agreement is governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. If a part of it is found unenforceable, the rest stands.

12. Contact
